This is the first segment of The Meadows’ staff nurse, Judy Beard R.N., giving deposition testimony (2004) regarding patient essment and policy compliance in reference to THE MEADOWS of Wickenburg’s Nursing Policy #750.

THE MEADOWS of Wickenburg is the renowned, remote and private facility that has treated such glitterati and public figures as Rush Limbaugh, Kate Moss, Elle MacPherson, Cindy McCain, and Eric Benet. THE MEADOWS is licensed as a Level 1 Psychiatric Acute Hospital by the State of AZ, Division of Behavioral Health Licensing and has full JCAHO accreditation. Marketed as a “dual diagnosis” facility, THE MEADOWS claims to treat addictions (e.g. drug, alcohol, sexual, work, etc.) as well as affective disorders such as anxiety, severe depression, PTSD, and Bi-Polar disorder. In spite of these facts, THE MEADOWS operates as an open campus with no secure or locked units. Furthermore, it has been grand-fathered out of a second AZ Department of Health License, a Hospital Facilities License, that would require THE MEADOWS to comply with Arizona hospital standards, regulations, and requirements.

On November 28, 2004, MEADOWS’ inpatient, R. Matthew “Matt” Burne, was able to walk out of the Acute Wing (Kiva) of this Level 1 Psychiatric Acute Hospital sometime during the middle of the night – through one of the unlocked and unmonitored doors – unnoticed and unobserved by any staff. Matt then hanged himself with his own belt (that was never confiscated by MEADOWS’ staff) from a tree on a horse farm adjacent to THE MEADOWS property. He had been at THE MEADOWS for only four days, during which time staff repeatedly documented Matt’s high levels of anxiety, depression and verbalized thoughts of hanging himself.

Per THE MEADOWS’ own internal nursing policy, #NSG750, inpatient Matt Burne should have been on Eye-to-Eye observation. Instead, and in spite of his anxiety, depression, sucidality, as well as Policy #NSG750, Matt was was placed on Q4 hours observation by his MEADOWS’ attending psychiatrist, Dr. Stephen Swift Brockway. This required staff to check on him only once every four hours and allowed Matt the opportunity to leave the Acute Wing (undetected) and complete suicide off premises.

Nurse Judy Beard was the last nurse to complete a suicide essment on Matt Burne. She did so at bedtime on the evening before he completed suicide.

This is the first YouTube segment of Primary Counselor Doug Dodge’s deposition taken for the wrongful death/medical malpractice lawsuit, BURNE v THE MEADOWS. In 2004, and for numerous (20+) years prior, Dodge had been at The Meadows. In his capacity as
a Primary Counselor, Doug Dodge was responsible for designing, coordinating, essing, monitoring and supervising patient treatment plans at THE MEADOWS. He also did individual and group counseling. Educationally, Doug Dodge holds a G.E.D. (General Educational Development)diploma. No further academic credentials can be located or verified for him. Doug Dodge was grand-fathered into Arizona State Licensure as a Counselor in May of 2004. This permitted him to opt out of new AZ Department of Health State Licensing requirements that were put into effect on July 1, 2004.

PLEASE NOTE FOR CLARIFICATION PURPOSES: At the 2:28 minute marker of this video, Doug Dodge states that Matt Burne was on “One-to-One” (observation). This comment is in error. At no time on the Friday, Saturday or Sunday preceeding his suicide was Matt ever placed on One-to-One or Eye-to-Eye observation. At the time Matt Burne walked out of the Acute Unit of this Level 1 Psychiatric Acute Hospital and completed suicide off premises, Matt Burne was being watched once every four hours (or Q4 observation). No staff knew that he had left or saw him leave the facility sometime between 3-6AM.

In November 2004, Dr. Brockway was an in-house, on-staff Psychiatrist at The Meadows of Wickenburg and was the attending psychiatrist for R. Matthew “Matt” Burne who died from suicide while an inpatient there on November 28, 2004.

Watch Dr. Brockway give sworn deposition testimony regarding THE MEADOWS of Wickenburg’s unlocked and unsecured Acute Unit, their open campus philosophy, his uncertainty about closed-circuit cameras, his interpretation of Meadows’ Policy #NSG750, and his clinical belief and judgment that (quote), “If we have 70 patients at The Meadows, there might be 20 at any one time that have suicidal ideation. So it’s a matter of degree. I put people on eye-to-eye when it’s a fairly serious suicidal ideation.” Who determines what a “serious suicidal ideation” looks like, and shouldn’t ALL suicidal ideation at a $1000.00+/day hospital or ANY hospital be taken seriously and patients protected?

Please note Dr. Brockway’s discussion of “highly suicidal” patients at the 10:27:42 marker. Policy NSG750 does not differentiate between levels of suicidality as who can discern that? All this policy refers to is SOME suicidal ideation, whether in a clinician’s eyes it be severe, mild, serious, feeting, etc.

Additionally, please note Dr. Brockway’s testimony at the 10:29:50 marker where he states, “If someone has SOME suicidal ideation, we keep them in Acute Care.” If this was one of the reasons why Matt Burne was – and other patients are – retained on the Acute Care Wing (i.e. his/their having “some suicidal ideation, “) then why didn’t this thinking continue through and apply to placing Matt on Eye-to-Eye observation per MEADOWS’ policy #NSG750 that clearly states, “This level is for patients with SOME suicidal ideation, or other fragile patients needing constant support?” If there “might be 20 patients at any one time that have suicidal ideation” (per Brockway’s deposition), then shouldn’t they ALL be on Eye-to-Eye per this policy? How can having “some suicidal ideation” be the basis for retaining a patient on the Acute Wing yet be ignored when applying policy NSG750 that lists it as a reason for using Eye-to-Eye observation in the first place? Can a facility/doctor pick and choose the meaning of “some suicidal ideation” for various situations?

Lastly, at the 10:30:47 marker, Dr. Stephen Brockway acknowledges and discusses Matt’s “fluctuating clinical picture.” This is consistent with the ebb and flow/fluctuation of suicidality. Isn’t it KEY to keep patients safe when they have a “fluctuating clinical picture,” particularly with suicidal ideation that is known to ebb and flow? And, when there is a policy in place to do so?

AZ MEDICAL BOARD-Dr. Stephen Brockway Part 3 (The Meadows)

Attorney Skip Simpson addresses the Arizona Medical Board on behalf of the complainants, Denise and Shelley Burne, and their brother, Matt Burne, in a complaint filed with the Board against Dr. Stephen Brockway. Dr. Brockway was an employee at The Meadows of Wickenburg and Matt Burne’s attending, direct care doctor while there. After a four day stay at The Meadows, Matt Burne completed suicide while an inpatient. Dr. Brockway documented Matt’s suicidal ideations in his records yet failed to follow The Meadows Policy # NSG 750 specifically written for high risk/suicidal patients.
